Are you a “protected” whistleblower? The answer to that question can be complicated because the answer can turn on the application of various laws. Generally, whistleblower laws protect people who engage in certain protected activity by reporting certain illegal activity. However, only some forms of reporting about some particular issues are protected under the law. So, if you think your boss has asked you to do something illegal, you are seeing the government get ripped off, or someone is getting hurt, you might want to consult one of our whistleblower attorneys, who can help provide guidance.
Here are some of the more common laws protecting Georgia employees:
Occupational Safety and Health Act (OSHA)
The Occupational Safety and Health Act (OSHA) protects whistleblowers reporting some kinds of unsafe workplace conditions in the workplace. For instance OSHA has various workplace safety rules, and reporting the violation of one of those rules very well may be protected activity.
Sarbanes-Oxley is the name of a group of federal securities laws, and they prohibit employers for retaliating against employees for filing, testifying in, or assisting any proceeding related to alleged violation of the security laws, or from providing information or assisting in a covered investigation.
The False Claims Act
The False Claims Act applies to protect people from reporting certain forms of waste in contracts your employer has with the federal government. Notably, if you report a violation to the government and the government takes the case, you could receive about one quarter of the damages.
There are additional laws, so if you think you have been wronged or are concerned about illegal activity in the workplace, then you are welcome to contact our whistleblower attorneys for a free consultation.
